Xinjiang Autonomous Region Further Regulates Exploration and Development of Coal Resources

In order to further standardize the exploration, development and management of coal resources and scientifically, reasonably and orderly develop, utilize and protect coal resources, the thirteenth executive meeting of the People's Government of Xinjiang Autonomous Region discussed and passed the Provisional Regulations on Further Regulating the Exploration and Development Management of Coal Resources.

The regulations require that the development of coal resources shall adhere to the principle of “source of project **”. Under the premise of meeting the overall planning of the mining area and the setting of mining rights, a mining development entity shall be implemented. At the same time, we must adhere to the principle of giving priority to environmental protection and strictly limit the development of coal resources around the ecological and environmental protection zones and on both sides of important rivers and lakes. The autonomous region will suspend the allocation of coal resources within the above-mentioned regions; enterprises that have already allocated coal resources should be within the prescribed time limit. Where the implementation plans for development projects, resource utilization directions, and project construction schedules are put forward and are not implemented according to the schedule, the allocated resources shall be uniformly allocated by the autonomous region. For the existence of "circle without probe" behavior, the right to recover the coal prospecting rights shall be withdrawn in accordance with the law. If the mining right holder does not carry out the construction of the mine within one year after receiving the mining permit, the Xinjiang Autonomous Region will cancel its mining rights according to law. If the mineral exploration right and mining rights of coal resources are transferred without approval, the autonomous region will reclaim the mineral rights for prospecting rights according to law.
